Competition Law

The competition law was enacted in order to ensure equal opportunity for all competitors in the form of fair competition on merit. The competition law covers several laws, particularly the Unfair Competition Law (UWG) that prohibits unfair competition practices by bidders and affords protection from competitive misdoings, as well as the Law against Restricted Competition (GWB) that is intended to preserve the institution of a competitive economy and simultaneously ensures equal access to the market for all competitors.

 

The competition law fulfills a supplementary function of the industrial property law (e.g., patents, utility models, trademarks, Design Patents) because it does not protect the intellectual or technical creativity, but rather its fair exploitation.
